New Hampshire Used Car Lemon Law: RSA 357-D Limits

RSA 357-D is a new-vehicle arbitration law. Used cars qualify only while the factory warranty still runs. Here is what that means on an as-is lot.

New Hampshire Used Car Lemon Law: RSA 357-D Limits

New Hampshire's lemon law, RSA 357-D, is a new-motor-vehicle arbitration program. A used car sits under it only while the manufacturer's original express warranty is still running and the other statutory tests are met. Once that warranty ends, the lemon board is not your remedy. New Hampshire also has no special cooling-off period for car purchases, so an as-is used sale is usually final the day you sign.

On Sunday, October 18, 2026, I read the BBB National Programs New Hampshire lemon law summary PDF, the FTC Used Car Rule at 16 CFR 455, and public DMV descriptions of RSA 357-D. The New Hampshire DMV and DOJ pages blocked automated fetches from this box, so I cite those by name with today's date instead of linking dead URLs. Not legal advice.

What RSA 357-D actually covers

RSA 357-D creates the New Motor Vehicle Arbitration Board, attached to the DMV. Covered vehicles purchased or leased in New Hampshire include passenger cars and other four-wheel vehicles at or under 11,000 pounds GVW, plus motorcycles and off-highway recreational vehicles. The BBB summary and DMV consumer notice both treat a "new motor vehicle" as one still under the manufacturer's express warranty, which is how a nearly new used car can still qualify. Government buyers are out. Tractors, mopeds and mobile homes are out.

The presumption of a reasonable number of repair attempts is three failed repairs of the same nonconformity during the warranty term, or 30 or more cumulative business days out of service during that term, with written repair orders. The defect has to substantially impair use, market value or safety. Filing windows run roughly one year after the later of warranty expiration or the manufacturer's final repair attempt, per the BBB summary updated September 2023. If you already chose the manufacturer's informal dispute program, RSA 357-D:4 can block a parallel lemon filing.

Honestly, most used cars on New Hampshire lots are outside RSA 357-D the day they arrive. Treat lemon-law hope as a bonus for late-model CPO leftovers still under factory paper, not as a safety net for a ten-year-old private sale.

What protects used buyers instead

  • The federal Buyers Guide on the window, required by 16 CFR 455, which states warranty or as-is.
  • Dealer licensing and unfair-trade rules enforced through the Attorney General's consumer office. NH DOJ has published used-car buying tips (pages blocked here; search "NH Consumer Insight used motor vehicle").
  • Title brands and salvage rules you can verify before money moves.

Our as-is used car guide walks through the Buyers Guide box. If a dealer hides a buyback history, our lemon buyback title brand post explains the stamps to look for.

Title homework in New Hampshire

Match the VIN on the title to the dash and door sticker. Read our New Hampshire salvage and rebuilt title rules, New Hampshire salvage title rules, and New Hampshire private sale title transfer posts before you wire funds. Search NMVTIS in case a brand from another state never printed on the New Hampshire paper.

No cooling-off for cars

Federal law does not give you three days to cancel a car bought from a dealer on the lot, and New Hampshire's lemon materials do not create one either. If a salesperson says you can "bring it back Monday, no problem," get that promise in the contract. Verbal undo buttons vanish after the ink dries.

Before you sign in NH

Have an independent mechanic inspect the car. Pull your own history report instead of trusting a seller PDF. We're a licensed CARFAX and AutoCheck reseller, not affiliated with CARFAX, AutoCheck or Experian. As of mid October 2026 reports run about $5.50 for guests and about $4.50 for members, with a bundle near $6.75, against roughly $39.99 to $44.99 retail. Confirm at checkout so the total you see is the total you pay. For nearby state comparisons, our Alaska used-car lemon law and Delaware used-car lemon law posts follow the same "new-car statute, used-car homework" pattern.
